Terms of Service

1. About BorrowBuddy

BorrowBuddy is a marketplace that connects Owners and Renters. BorrowBuddy does not own, inspect, store, manufacture, or endorse any of the items listed on the Platform. All rental arrangements are made directly between Users. BorrowBuddy is not a party to the rental agreement between Owner and Renter, except where expressly stated in these Terms.

2. Eligibility

To use BorrowBuddy, you must: Be at least 18 years old Create an account with accurate, current information Comply with all applicable laws Agree to these Terms and our Privacy Policy BorrowBuddy may suspend or terminate accounts that provide false information or violate platform rules.

3. User Accounts

3.1 Account Responsibility You are responsible for: Maintaining confidentiality of your login credentials All activity under your account Ensuring your profile information is accurate BorrowBuddy may request additional information, such as identity verification, at our discretion. 3.2 Communication By using the Platform, you consent to receiving emails, notifications, and transaction-related messages from BorrowBuddy.

4. Listings and Items

4.1 Owner Responsibilities Owners must: Provide accurate descriptions, photos, and availability Ensure items are clean, safe, and in good working order Set a clear pickup location or meeting point Communicate promptly with Renters Comply with local laws and regulations governing rentals Owners are solely responsible for the safety, legality, and condition of their items. 4.2 Prohibited Items Owners may not list items that are illegal, unsafe, stolen, or otherwise restricted. BorrowBuddy may remove listings that violate these Terms.

5. Rentals and Transactions

5.1 Booking a Rental When a Renter books an item: A binding agreement is created between the Renter and the Owner Payment is collected through BorrowBuddy’s payment processor (e.g., Stripe) Booking details are shared between both parties 5.2 Pickup and Return Renters must: Arrive on time for pickup Return items in the same condition Communicate immediately if issues arise Owners must provide the item at the agreed time and location. 5.3 No-Shows If a Renter fails to appear, the Owner is not required to issue a refund (see Section 7).

6. Fees and Payments

BorrowBuddy uses third-party payment processors. By using the Platform, you agree to their payment terms. BorrowBuddy may charge service fees, processing fees, or listing fees. These fees are shown at checkout and are non-refundable unless otherwise stated. Payment disbursements to Owners occur after the rental start time unless platform rules specify otherwise.

7. Cancellations and Refunds

BorrowBuddy’s cancellation policy applies to all rentals: 7.1 Renter Cancellations More than 24 hours before start time:
100% refund of rental price, minus service fees and any insurance/add-on fees Within 24 hours of start time:
50% refund of rental price; fees non-refundable No-show or cancellation during rental period:
No refund 7.2 Owner Cancellations If an Owner cancels due to weather, emergencies, unavailability, or reasons outside the Renter’s control, the Renter will receive a full refund. 7.3 Mutual Cancellations If both parties agree to cancel, BorrowBuddy may issue a full or partial refund upon confirmation.

8. Damage, Loss, and Liability

8.1 Renter Responsibility Renters are responsible for: Returning items in the same condition Compensating Owners for damage, loss, theft, or excessive wear BorrowBuddy may assist in communication but does not resolve disputes or guarantee outcomes. 8.2 Owner Responsibility Owners must ensure items are safe and functional. Owners acknowledge that normal wear and tear may occur. ⚠️ 8.3 Insurance BorrowBuddy does not currently provide insurance for rentals.
Users participate at their own risk.
Owners and Renters may choose to independently obtain coverage. BorrowBuddy may introduce optional insurance products in the future, which would be governed under separate terms.

9. User Conduct

Users agree not to: Violate laws, rules, or regulations Post false, misleading, or harmful content Damage or misuse items Harass, threaten, or defraud other users Interfere with the Platform’s functionality Create multiple accounts or impersonate others BorrowBuddy may suspend or terminate accounts for violations.

10. Marketplace Safety

BorrowBuddy encourages safe interactions but cannot guarantee user behavior. Users must rely on their own judgment when meeting, exchanging items, or assessing risk. BorrowBuddy is not responsible for any harm, injury, loss, or damages arising from interactions or transactions between Users.

11. Platform Access and Modifications

BorrowBuddy may: Modify or discontinue the Platform Update features or pricing Suspend accounts or listings Change these Terms Changes will be communicated by updating the “Last Updated” date. Continued use constitutes acceptance.

12. Intellectual Property

All content on the Platform, including branding, logos, graphics, and interface design, is owned by BorrowBuddy or its licensors.
Users may not copy, scrape, reverse-engineer, or reproduce Platform content without permission. Users retain ownership rights to their photos and listing content but grant BorrowBuddy a license to display and use them for Platform purposes.

13. Disclaimers

BorrowBuddy provides the Platform “as is” and without warranties of any kind.
We do not guarantee: Item quality or safety Availability User behavior Accuracy of listings Continuous or error-free platform operation To the fullest extent permitted by law, BorrowBuddy disclaims all implied warranties.

14. Limitation of Liability

To the maximum extent permitted by law, BorrowBuddy is not liable for: Damages arising from user interactions Loss, theft, or damage of items Personal injury Disputes between Renters and Owners Platform outages or errors Indirect, incidental, or consequential damages BorrowBuddy’s total liability will not exceed the greater of (a) $100 or (b) the amount paid to BorrowBuddy in the past 12 months.

15. Indemnification

Users agree to indemnify and hold BorrowBuddy harmless from claims, damages, losses, and expenses arising from: Violations of these Terms Improper use of the Platform Damage to rented items Misconduct towards other Users Listing prohibited or unsafe items

16. Termination

BorrowBuddy may terminate or suspend accounts at any time for: Policy violations Fraud Unsafe or illegal activity Failure to cooperate in disputes Harmful behavior toward the community Users may delete their account at any time.

17. Governing Law

These Terms are governed by the laws of the State of [Your State], without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in [Your County/State], unless otherwise required by law.
